UPDATE: Manchin and Schumer's Dirty Deal is dead—again! Activists and progressive lawmakers pushed back against this backdoor deal, and Democratic leadership did not have enough votes to attach it to the must-pass National Defense Authorization Act.

Senator Manchin has re-introduced his destructive agenda in a must-pass year-end legislation, the 2023 National Defense Authorization Act (NDAA), with NY Senator Schumer’s blessing. People vs. Fossil Fuels, a coalition of over 1,200 grassroots, frontline and national organizations are taking action to express opposition to any further fossil fuel giveaways.

Why it is important to kill Machin’s dirty deal:
To secure Senator Manchin’s vote on the Inflation Reduction Act (IRA), NY Senator Schumer made a backroom deal with Machin last July on a follow-up permitting overhaul bill that would result in changes to the energy approval process. Democratic leaders are trying to slip in the permitting provisions into the latest version of the fiscal 2023 NDAA act
The permitting provisions are designed by and for the fossil fuel industry to make it easier and faster to get permits for fossil fuel projects. It weakens existing environmental protection laws such as the Clean Water Act and the National Environmental Policy Act (NEPA), by making it more difficult for the public to challenge harmful fossil fuel projects in court
This plan would attempt to rubber stamp the Mountain Valley Pipeline – a dirty project that neighboring communities have been fighting for years, that is missing many permits, and that has been rejected by courts
The public has to be able to have a say – especially the frontline, low-income and BIPOC communities that have far too often suffered as a result of these projects. That is paramount to climate justice
This dirty deal will directly undercut President Biden’s climate agenda that he touted at COP27 and any positive impacts of the IRA. The Biden administration must reject this dirty deal
